we may use third-party payment processors and do not store full payment card details on our own systems.

11. Refunds and Cancellations

AVAILABILITY;
SECURITY;
RELIABILITY; AND
ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR YOUR NEEDS.
WE DO NOT WARRANT THAT THE SERVICES WILL IMPROVE YOUR HEALTH, MENTAL STATE, EMOTIONAL STATE, PERFORMANCE, OR QUALITY OF LIFE.
18. Assumption of Risk
You knowingly and voluntarily assume all risks associated with your use of the Services, including any decisions, actions, or omissions you take based on the Services.
If any Service includes breathwork, movement, sound, mindfulness, guided exercises, emotional processing, lifestyle changes, or other wellness practices, you agree that you are solely responsible for determining whether participation is appropriate for you.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, META LAB LLC, M374, AND THEIR OFFICERS, OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, LICENSORS, AGENTS, SUCCESSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES.
THIS LIMITATION APPLIES INCLUDING, WITHOUT LIMITATION, TO CLAIMS INVOLVING:
PERSONAL INJURY;
EMOTIONAL DISTRESS;
LOST PROFITS;
LOST DATA;
BUSINESS INTERRUPTION;
HEALTH OUTCOMES;
RELIANCE ON CONTENT;
ERRORS OR OMISSIONS; OR
THIRD-PARTY CONDUCT.
TO THE EXTENT ANY LIABILITY CANNOT BE DISCLAIMED, THE TOTAL CUMULATIVE LIABILITY OF META LAB LLC SHALL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID TO META LAB LLC FOR THE RELEVANT SERVICE IN THE 3 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
USD $100.
20. Indemnification
You agree to defend, indemnify, and hold harmless Meta Lab LLC, M374, and their officers, owners, members, managers, employees, contractors, licensors, agents, successors, and affiliates from and against any claims, liabilities, damages, judgments, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your use or misuse of the Services;
your violation of these Terms;
your violation of any law or third-party right; or
content, information, or materials you submit or share through the Services.
21. Termination
We reserve the right, in our sole discretion and without liability, to suspend, restrict, or terminate your access to any Service at any time, with or without notice, if we believe you have violated these Terms, pose a risk to us or others, or engaged in misuse, fraud, abuse, or unauthorized sharing.
22. Privacy
Your use of the Services is also subject to our Privacy Policy. By using the Services, you acknowledge that personal information may be collected, used, and disclosed as described in that policy.
23. Modifications to the Services and Terms
We may modify, suspend, discontinue, or update any part of the Services at any time.
We may also update these Terms from time to time. The updated version will be posted with a revised effective date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
24. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of laws principles.
25. Dispute Resolution
To the maximum extent permitted by law, any dispute arising out of or relating to these Terms or the Services shall first be submitted to Meta Lab LLC in writing at contact@mata-lab.io with a reasonable opportunity to resolve the matter informally.
If the dispute is not resolved informally, Meta Lab LLC may require that disputes be resolved exclusively in the state or federal courts located in California, and you consent to personal jurisdiction and venue there, unless applicable law requires otherwise.
If you prefer arbitration language instead of court-based language, consult a qualified attorney before using it, as arbitration clauses and class-action waivers should be tailored carefully.
26. Severability
If any provision of these Terms is found unenforceable or invalid, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
27. Entire Agreement
These Terms, together with any policies or terms expressly incorporated by reference, constitute the entire agreement between you and Meta Lab LLC regarding the Services and supersede prior or contemporaneous understandings relating to the same subject matter.
